Please read these Terms of Service ("Terms") carefully before using the Streak Master mobile application ("App") operated by Bandiago ("we", "our", or "us").
By accessing or using the App, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any of these Terms, you are prohibited from using the App.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes subject to these Terms.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
We do not warrant that: (a) the App will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the App is free of viruses or other harmful components; or (d) the results of using the App will meet your requirements.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BANDIAGO, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE APP.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE LAST SIX (6) MONTHS, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.
The App is designed to help you track habits and is for informational purposes only. The App does not provide medical, health, psychological, or any other professional advice. You should consult appropriate professionals before making any decisions based on information from the App.
You expressly acknowledge and agree that your use of the App is at your sole risk. You are solely responsible for any damage to your device or loss of data that results from using the App.
Some features of the App require a paid subscription. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions through your Google Play account settings.
ALL PAYMENTS ARE NON-REFUNDABLE. We are not responsible for any charges incurred due to failure to cancel a subscription.
You agree to defend, indemnify, and hold harmless Bandiago and its affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Bandiago is registered, without regard to its conflict of law provisions.
Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration, rather than in court. You waive any right to participate in a class-action lawsuit or class-wide arbitration.
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
We reserve the right to modify or replace these Terms at any time. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
