These Terms of Service ("Terms") govern your use of the Android application "Sound Level Meter" (the "Application") provided by Bandiago (the "Developer"). By installing or using the Application you agree to these Terms. If you do not agree, do not use the Application.
The Developer grants you a limited, non-exclusive, non-transferable, revocable license to use the Application on devices that you own or control, solely for personal, non-commercial purposes. The Application is licensed, not sold, to you.
The Application is not a certified sound level meter. It uses your phone's microphone, which is designed for speech and is not a calibrated measurement instrument. Readings are indicative only.
Phone microphones cannot measure much above about 100–120 dB, they differ from device to device, and the operating system may process the microphone signal. The Application therefore cannot be accurate in the way a calibrated, type approved instrument is accurate. It includes a calibration offset so that you can align it with a reference meter if you have one, but the Developer cannot verify the accuracy of your device or of any calibration you apply.
Do not rely on the Application as the only basis for any decision that matters — in particular decisions about your hearing, your hearing protection, the safety of a workplace, compliance with occupational noise limits, the safety of other people, or evidence in a dispute, complaint or legal proceeding. For those purposes use a properly calibrated instrument, or obtain professional advice.
Exposure figures such as dose percentages are calculated from the readings of this microphone using published NIOSH and OSHA reference limits. They summarise what the Application measured; they are not a certified dosimetry result.
Everything you measure or record with the Application stays on your device. You are responsible for it, for exporting or sharing it if you need a copy, and for keeping your own backups. Uninstalling the Application, or clearing its data, permanently deletes your measurement log.
You agree to use the Application lawfully, and not to use it to monitor people where doing so would be unlawful or would violate their privacy or their rights, and not in any way that damages, disables or impairs the Application or interferes with other users.
The Application is supported by advertisements served through Google AdMob. By using the Application you acknowledge that advertisements will be displayed and that Google processes certain data as described in the Application's privacy policy (see bandiago.com/policies/sound_level_meter_privacy_policy.html), which forms part of these Terms.
THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. THE DEVELOPER DOES NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED OR ERROR-FREE, THAT MEASUREMENTS WILL BE ACCURATE, OR THAT THE APPLICATION WILL RECORD EVERY SOUND, NOISE EVENT OR MEASUREMENT, AS DEVICE HARDWARE, BATTERY OPTIMISATION AND OPERATING SYSTEM RESTRICTIONS CAN AFFECT MEASUREMENT AND BACKGROUND OPERATION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, LOSS OF PROFITS OR REVENUE, OR FOR ANY DAMAGE, INJURY, LOSS OR DISADVANTAGE ARISING FROM RELIANCE ON A MEASUREMENT, READING, EXPOSURE FIGURE OR EXPORTED REPORT PRODUCED BY THE APPLICATION. IN NO EVENT SHALL THE DEVELOPER'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APPLICATION (IF ANY).
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for fraud, or your mandatory statutory rights as a consumer in the country where you live.
You may stop using the Application and uninstall it at any time. The Developer may update the Application and these Terms from time to time; the current version of these Terms will be published on this page. Continued use of the Application after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Netherlands. Nothing in this section affects the mandatory consumer protections you are entitled to under the law of the country in which you live.
